FIREWORKS LAWS IN PENNSYLVANIA

If you feel that the special moments in life are better with loud booms and colorful explosions in the sky, you're in good company. While the tradition of using fireworks for popular events dates back almost as far as the concept of celebrating things, the laws surrounding firework usage in Pennsylvania have an equally long history.

While Pennsylvania state firework restrictions are not as strict as those in other states, there are some rules and regulations to keep in mind to ensure your party doesn't end with the unexpected appearance of our men and women in blue.

WHICH FIREWORKS CAN PENNSYLVANIA RESIDENTS BUY AND USE?

With the signing of Act 74 of 2022, any Pennsylvania consumer over 18 can now purchase and use “consumer-grade” or “Class C” fireworks. This classification includes fireworks containing 50 milligrams of explosive material at most. Some examples of consumer-grade fireworks are:

  • Bottle rockets
  • Roman candles
  • Firecrackers

“Display fireworks” contain up to 130 milligrams of explosives. Given the hazardous nature of these fireworks, only professionals may purchase them and the municipality that will be hosting the display must issue a permit beforehand.

WHO CAN PURCHASE FIREWORKS?

Turning 18 in Pennsylvania is exciting for many reasons, one of which is reaching the legal age to purchase consumer fireworks. Before you rush out after slicing the cake, however, it's important to remember that toy caps, novelties, and ground and hand-held sparkling devices are not considered consumer fireworks.

RESTRICTIONS ON USAGE

While every municipality may have its own set of regulations and local ordinances, some general restrictions to keep in mind when purchasing and igniting fireworks are:

  • One cannot ignite or discharge fireworks on private property without the property owner's permission.
  • You cannot direct fireworks at a person.
  • One cannot discharge or direct fireworks at a vehicle or building.
  • You cannot discharge fireworks within 150 feet of a building or vehicle, even if they are your personal property.
  • You cannot discharge fireworks if you are under the influence of alcohol or other controlled substances.

A municipality can also limit firework usage between 10 p.m. and 10 a.m. on any day except July 2, 3, 4 and December 31. During these days, one may use fireworks until 1 a.m. If the Fourth of July is on a Tuesday, Wednesday or Thursday, individuals can use fireworks on Friday and Saturday until 1 a.m.

While we trust that you will be a law-abiding citizen, you'll find that deciding the rules are optional means the following entities have the right to take your fireworks:

  • Public safety partnership
  • Local police officers with Act 120 certification
  • Sheriffs or sheriff deputies
  • Any member of the Pennsylvania bomb squad with accreditation from the FBI and certification in hazardous devices training
